Country refers to: The Philippines
Device means any device that can access Our Website such as a computer, a cell phone or a digital tablet.
Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of Our Website.
Products and Services refer to the products, services or items offered for sale on our Website.
Orders mean a request by You to purchase Products from Us.
Promotions refer to contests, sweepstakes or other promotions offered through our Website.
Our/The Website refers to the Subic Bay Life Website and its Wocommerce Shop, Business & Service Directory, Real Estate Listings and Vacation Rentals, accessible from https://www.subicbaylife.com
Terms and Conditions (also referred as “Terms” or “Terms of Use” or “Agreement”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of Our Website.

Members are people and businesses who list their profiles, properties, products, services and Tours & Activities with us.
Stores are custom online shops the Members create to sell their own products.

Errors in Your Order: We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.
 

Your Order Cancellation Rights

Any Products or Services you purchase can only be returned or refunded in accordance with these Terms & Conditions and our Refund & Returns Policy.

Availability, Errors, and Inaccuracies

We are constantly updating Our offerings of Products and Services. The Products and Services available may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Products and Services and in Our advertising on other websites.
 
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Payment can be made through various payment methods we have available, such as Visa, MasterCard, American Express cards, or online payment methods, through our Stripe Payment Gateway.
 
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.

Subic Bay Life offers two kinds of subscription Memberships, Private Membership and Professional Membership. Both Memberships allow for the use of our Listing Services with different durations and listing options.
 

Private Membership

The Private Membership allows for the listing and publication of your Business Listing, one Property and one Vacation Rental as well as creating your own online Shop for Products, Services and Tours & Activities for the duration of one month (30 days).

Duration and Extension:

  • Your Membership and Listings are valid for 1 month (30 days).
  • Your Membership and Listings will automatically renew for another month (if not cancelled)

Support & Service:

  • Automated postings to Social Media
  • WhatsApp Chat for help and support questions
* Coming in summer 2025
 
Although the Private Memberships allows for all the same features as the Professional Membership, it is limited to just one Listing for Real Estate and one Vacation Rental listing. It is primarily aimed at Members who are listing their property for rent or lease and only expect it to be online for a few months. You may create a Company Profile as well as a custom online Shop to list products and Services. This however makes less sense to do on a monthly subscription and we recommend to use the Professional Membership for that.
 

Professional Membership

The Professional Membership allows for the listing and publication of a your Company Profile, multiple Properties, Vacation Rentals, Products, Services and Tours & Activities for the duration of one year (365 Days). The minimal subscription duration is 1 year.

Business Profiles and Real Estate Listings

Business Profiles and Real Estate Listings are intended to provide information and generate leads for the listing Members. The primary conversion goal is the direct contact between the potential client and the listing Member. This contact is direct and happens without Subic Bay Life being an intermediary.
It is the listing Member’s obligation to keep all information and listings accurate and up to date.
 

Subic Bay Life Stores

Subic Bay Life allows Members to create their own online Stores on the Subic Bay Life platform to sell Products, Services and Tours & Activities. The Member has the choice of selling directly on their Subic Bay Life Store or linking their offerings to their own online shop for payment processing (External/Affiliate Product).
 

Listing of Products, Services and Tours & Activities

When creating any type of sellable offering the listing Member can choose the following options:
  • Simple Product (Individual product or service with price)
  • Grouped Product (Simple products or services that are integrally connected like a toy with the required batteries or a furniture set composed of several components)
  • External/Affiliate Product (Products or services linked to an external shop for payment, fulfillment and distribution – does not use the Subic Bay Life Payment Gateway)
  • Variable Product (Simple product in several variations, like t-shirts in different sizes and colors)
  • Bookable Product* (These are products and services that require the selection of a time and date. This can be an activity that takes place every Saturday morning and is limited to 10 participants. Members can even create appointment bookings for services and manage resources (rooms, employees, etc.) and synchronize their availability calendars)

Products can be virtual and even downloadable.

 

Shipping & Taxes

Subic Bay Life Members create their own Stores and are responsible for the Shipping and the Taxation of their Products and Services. Subic Bay Life (CCI LLC) is not responsible or liable for the Offerings or the Fulfillment of the Members’ Stores. The Members indemnify and hold Subic Bay Life *CCI LLC) harmless in any legal disagreement deriving from their Subic Bay Life Store.
 

Facebook Shop and Google Shopping

If entered properly, the Products and Services listed within any Subic Bay Life Store will also appear in the Subic Bay Life Catalog of Meta Commerce (Facebook & Instagram Shop) as well as in Google Shopping, through the Subic Bay Life Accounts. Checkout and Payment for any such Products and Services will happen in the Subic Bay Life Stores.
 

Payment Gateway

Subic Bay Life offers our Members the use of our PCI compliant payment Gateway. This enables customers to pay online with credit cards and online payment methods (currently Cash On Delivery, PayPal or Bank Transfer)
 

Payment Process

The customers pay online through the payment option provided by the Store

(currently Cash On Delivery, PayPal or Bank Transfer). Subic Bay Life (CCI LLC) is not involved with the payment, we only provide the technology. The Store Owner connects his/her own bank connection and/or PayPal account in the Store settings.
 
The Currency by default is Philippine Peso PHP.

Subic Bay Life does not collect any Fees for the Payment Process. Your regular Fees from your Bank or your PayPal account apply.

Each Store Owner facilitates their own Payouts, Refunds and Returns.

Listing of Vacation Rentals (Coming in summer 2025) as well as other Products and Services need not be processed directly through the Subic Bay Life Payment Process. If you have a preferred Checkout Option, AirBnB or your own Web Shop, you may create your offerings as Affiliate products and the client is redirected to your Checkout Option for payment processing.

Entire Agreement

These Terms & Conditions (Agreement) contain the entire agreement between Members and the Company and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Agreement. This Agreement replaces and supersedes any prior written or oral agreements between the Parties.

 

Severability

If any provision of this Agreement will be held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision will be deemed to be written, construed, and enforced as so limited.

 

Indemnity

The Parties agrees to indemnify and hold harmless and defend the each other, their officers and employees from and against all claims and suits by third parties for damages, injuries to persons (including death), property damages, losses, and expenses including court costs and reasonable attorney’s fees, arising out of, or resulting from, either parties performance under this Agreement, including all such causes of action based upon common, constitutional, or statutory law, or based in whole or in part, upon allegations of negligent or intentional acts on the part of the either party, its officers, employees, agents, subcontractors, licensees, or invitees.

 

Liability

The Parties agree to be responsible and liable for their own actions and activities independently.

Parties found liable shall pay their proportionate share of damages as agreed by the parties or as ordered by a court of competent jurisdiction over the case.
